NEW YORK (WCBS 880) — A week before the end of the legislative session in Albany, Gov. Cuomo says it’s time to ban the gay and trans panic defenses.

“It is the institutionalization of homophobia,” Cuomo says.

He says applied to anything else it would never be allowed.

“When I found out he was Catholic, I was so disturbed that I was out of my mind and when I found out she was Jewish, I was so disturbed I was out of my mind, it is ridiculous,” he continued.

There’s also an effort to end a ban on surrogates in New York.

TV producer and "Watch What Happens Live'' host Andy Cohen says he was stunned to learn it wasn’t an option here in the state, “I came to New York from the Midwest so I could be free to live my life but I had to leave New York to have a child.”

Cohen, whose son was born through a surrogate, added, “In 2019, no one should have to forfeit the joy of raising a child.”

The Senate plans to vote on repealing the ban Tuesday.
