NEW YORK (WCBS 880) — The city Health Department is warning all restaurants to rid themselves of any food laced with CBD or face fines.

CBD, the non-psychoactive byproduct from hemp plants, is becoming an ingredient at a handful of restaurants across the city, mixed into fudge for an ice cream sundae, folded into foam lattes, and drizzled within dressings on salads.

The Health Department is trying to remind businesses that according to the FDA, it is still unlawful to add CBD to food or drinks.

Starting in October this year, restaurants caught adding CBD to their food and drink could be fined $200.

While people can not get high from CBD, supporters say it provides a calming effect when eaten and may help with anxiety and pain.

Council Speaker Corey Johnson calls the threat of fines an overreaction and says the council may look at legislation to make CBD legal at restaurants.
