MOUNT VERNON, N.Y. (WCBS 880) — After weeks of uncertainty, a hearing in Westchester County on Wednesday determined Richard Thomas is no longer the mayor of Mount Vernon.

When Thomas pleaded guilty to criminal charges three weeks ago, the city council order him the leave office, but he refused.

However, a judge Wednesday ruled he would have to leave his post.

Thomas argued his plea agreement gave him until Sept. 30, but the city charter indicates the conviction means Thomas must vacate his position immediately.

Drama continued when Council President Andre Wallace was chosen as acting mayor.

“The bottom line is, I am the mayor of Mount Vernon,” Thomas said on July 12. “The distractions and the continued antics by the City Council is just that, irresponsible antics and distractions.”

Thomas pleaded guilty to misusing campaign funds.

He was sentenced to a one-year “conditional discharge,” during which he will not be able to seek any appointed or elected public office seat. He also has to pay a $13,000 fine.
