NEW YORK (WCBS 880) -- New York City is suing the Department of Justice over a public safety grant the city says is not being handed out.

That grant is $4 million, and is named after Edward Byrne – an NYPD officer killed nearly 30 years ago while protecting an immigrant who was a cooperating witness.

The Mayor’s office said the city has gotten the money for that grant every year since it began in 2005.

The lawsuit said the DOJ forced city officials to enforce immigration laws in New York City.
