Ex-NYPD Detectives Get Probation For Sexual Encounter With Arrested Teen

NEW YORK (WCBS 880) -- Two former NYPD narcotics detectives have been sentenced to five years' probation for having sex while on-duty inside a police van with a teen they had arrested.

Eddie Martins, 39, and Richard Hall, 34, pleaded guilty in August to 11 counts of bribe receiving and official misconduct stemming from the September 2017 encounter.

Prosecutors dropped more than 40 kidnapping and rape charges against Martins and Hall in March, citing "serious credibility issues.''

Prosecutors said Martins and Hall had sex with the woman in a police van after arresting her for drug possession before releasing her without authorization and without reporting the arrest in Brooklyn back on Sept. 15, 2017.

Both detectives resigned after the incident and claimed that the sex was consensual, which at the time wasn't against the law. Legislators have since closed that loophole, making it illegal for officers to have sex with someone in their custody.

“These defendants lost their jobs and are now convicted felons because of the appalling abuse of power to which they admitted. This incident led to a change in New York law, closing a loophole that allowed officers to claim that sex with a detainee was consensual," Brooklyn District Attorney Eric Gonzalez said. "Unfortunately, we could not apply that new law retroactively. While my Office recommended prison time, we accept the Court’s sentence.”

The detectives faced an administrative proceeding that could have resulted in their firing.
