NEW YORK (WCBS 880) -- The Legal Aid Society has won an emergency stay on behalf of an immigrant from China who has been living in Queens since 2000 to escape religious persecution.

Xiu Qing You, 39, was free Wednesday night after having been detained by Immigration and Customs Enforcement officials since May 23, following a mandatory interview for a green card that was petitioned by his wife.

You runs a nail salon in Connecticut with his wife, who is a U.S. citizen.

He is a father of two young children and has no criminal record.

On Monday, immigrant advocates and Asian-American groups rallied in Foley Square calling for his release.
